WHAT THE USCIS SAYS

As per The U.S.Citizenship and Immigration Services (USCIS) policy memorandum 602-0038.1 dated June 2012;
“A request for expedited processing of an eligible petition must include sufficient evidence to support the claimed need for expedited processing or an explanation of why that evidence is lacking.”

Having cited this, it is clear to say that a well written expedite request memo with supporting documentation or a detailed explanation of its absence, is the determining factor to raising a successful expedite request at any phase of your U.S. immigration journey. This is also inclusive of the very fact that according to the USCIS, you can raise as many requests for the expeditious processing of your case as many times as possible IF your situation changes at any time during the processing of your case.

Also, as a worker under the DHS’ Essential Critical Infrastructure category, most applicant’s petitions are eligible for expedited treatment especially if a delay in the adjudication of such petitions would be contrary to a National Interest or cause severe loss to a government-affiliated private project, but this has to be very well documented. USCIS EXPEDITE CRITERIA

According to the USCIS’ Expedite Criteria or Circumstances, as stated and on quote; “On or after June 9, 2021, USCIS may expedite a benefit request if it falls under one or more of the following criteria or circumstance:

Severe financial loss to a company or person

provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure: (1) to timely file the benefit request; or (2) to timely respond to any requests for additional evidence (RFE);[3]

Emergencies and urgent humanitarian reasons;

Nonprofit organization (as designated by the Internal Revenue Service (IRS))

whose request is in furtherance of the cultural or social interests of the United States;

U.S. government interests

(including cases identified as urgent by federal agencies such as the U.S. Department of Defense (DOD), U.S. Department of Labor (DOL), National Labor Relations Board (NLRB), the Equal Employment Opportunity Commission (EEOC), the U.S. Department of Justice (DOJ), the U.S. Department of State (DOS), DHS, or other public safety or national security interests);
